The Quick Answer

Most Frisco and North Texas small businesses start with a **Business Owners Policy (BOP)**, which bundles general liability, commercial property and business income, then add **commercial auto** if anyone drives for work. Two gaps catch owners often: **personal auto policies typically exclude business use**, and **homeowners policies largely exclude a home-based business**. Hail and wind are the big North Texas property risks, so a commercial roof, a **percentage wind/hail deductible** and a realistic business income period matter here. **Professional liability**, **cyber**, **EPLI** and a **commercial umbrella** round out the program as needed. **Texas is the only state where workers' comp is optional for most private employers**, but a **nonsubscriber** loses key defenses under **Texas Labor Code §406.033** and must file an annual notice (**DWC Form-005**). **33° North Insurance Group** is an **independent agency in Frisco** that compares multiple insurance companies. Frisco Business Insurance, The Short Version

## Good business insurance starts with what you do. Then we shop it.

A consultant working from a spare bedroom in Prosper, a salon in a Frisco strip center, a remodeling crew running jobs from McKinney to Little Elm, a family that owns a couple of rental houses: each one needs something different, and none of them needs the whole catalog. Most small businesses start with a **Business Owners Policy**, which packages general liability, commercial property and business income. From there, we add what your work actually calls for, like **commercial auto** if anyone drives for work.

We're an **independent agency**, which means we represent **multiple insurance companies**. We shop your coverage across several carriers, compare what comes back, and walk you through it in plain English. Robert Hutchings is a Texas-licensed agent based in **Frisco**, and we work with business owners across Collin and Denton Counties and all of Texas.

Two things shape the conversation in North Texas. The first is **weather**. Hail, straight-line wind and spring storms take a toll on commercial roofs, signs and rooftop HVAC units, and many policies carry a **percentage wind/hail deductible** rather than a flat dollar amount. Roof age can change how a roof claim is settled, and the February 2021 winter storm showed what burst pipes can do to a business that has to close for repairs. Check your property limits, your deductible and your business income period before storm season.

The second is **workers' comp**. **Texas is the only state where workers' comp is optional for most private employers.** Employers who opt out are called **nonsubscribers**, and going without it changes what happens if an employee is hurt on the job. We'll walk you through both roads below. Nothing on this page is legal advice.

## What a business actually needs. In the order it matters.

Start with the package, then add what your work demands: who you employ, what you drive, the data you hold and what a North Texas hailstorm could take off the roof.

Start here

BOP

### Business Owners Policy

Bundles general liability, commercial property and business income into one package built for small businesses. It often costs less than buying the pieces separately, and for many Frisco offices and shops it's the core of the program.

Core

Liability

### General Liability

The customer who slips in your shop, the damage you cause at a client's site, the advertising injury claim. It helps pay defense costs as well as settlements, and it's what your landlord, general contractor or clients will want a certificate for.

Core

Property

### Commercial Property

Your building or leasehold improvements, furniture, equipment and inventory. Hail, straight-line wind and spring storms hit North Texas roofs, signs and HVAC units hard, so check your limits and how your roof would be settled.

Core

Reopen

### Business Income

Property coverage repairs the building. This helps pay your rent, payroll and lost profit while that happens. Set the restoration period to a realistic timeline, because after a big hailstorm contractors are booked across the region.

Texas rule

Optional*

### Workers' Compensation

Optional for most private Texas employers, the only state where that's true. Skip it and you lose key legal defenses under §406.033. *Government construction contracts and many GC agreements require it anyway. Ask us what's available.

Drive for work

Auto

### Commercial Auto

Personal auto policies typically exclude most business use. Vehicles owned by the business need commercial auto, whether it's one car or a few trucks. If staff drive their own cars on your errands, ask about hired and non-owned coverage.

Ask us

E&O

### Professional Liability

General liability doesn't cover a mistake in the professional services you provide. If clients pay you for expertise and an error could cost them money, this is the coverage that responds, and your contracts may require it.

Customer data

Cyber

### Cyber Liability

A data breach can mean forensic work, notifying customers, legal help and lost income while systems are down. If you take cards or keep customer records, it's worth a look. Coverage varies, so we'll go through it with you.

Your team

EPLI

### Employment Practices Liability

Responds to claims like wrongful termination, discrimination and harassment, which can come up in any business with staff. It's worth a conversation once you have even a few employees.

Extra limits

Umbrella

### Commercial Umbrella

Sits on top of your general liability, commercial auto and employer's liability limits and adds another layer when a serious claim runs past them. Common when contracts call for higher limits.

Not covered

Home Office

### A Business On Your Homeowners Policy

Business property in the house usually has a small limit, and business liability is generally excluded. A client who trips on your front step may not be a covered claim. An endorsement or a small business policy often fixes it.

Not covered

Flood

### Flood On A Business Policy

Flood is excluded from most business property coverage, and flash flooding happens across North Texas. Separate flood coverage is available, and NFIP policies usually have a 30-day waiting period, so don't wait for the forecast.

### Not sure what your business needs?

Covering Your Team

## Texas workers' comp, in plain English.

If you have employees, this is worth reading, because Texas handles workers' comp differently from every other state. It's general information, not legal advice, and whether comp is right for you is a question to ask us directly.

### The choice, and who actually has it

Most private Texas employers may legally choose whether to carry workers' compensation. Carry it and you're a **subscriber**. Decline and you're a **nonsubscriber**. The choice is narrower than it looks: contractors on **government building and construction contracts** must provide coverage under **Texas Labor Code §406.096**, and many general contractors, builders and property managers write comp requirements into their agreements. If your work comes through a GC, the state's permission to skip comp may not mean much.

### What going without actually costs

A subscriber's injured employees generally go through the comp system, with defined benefits, instead of suing. A nonsubscriber gives that up, and **Texas Labor Code §406.033** takes away three defenses an employer would normally raise: **contributory negligence**, **assumption of risk** and **fellow-employee negligence**. The employee generally needs to show your negligence played a part, and damages aren't limited to a benefits schedule. That's the trade: premium savings now, open-ended exposure later.

### Nonsubscriber, done properly

Some businesses still reasonably choose it. If that's your road, take it deliberately: the status requires an **annual notice to the Texas Department of Insurance, Division of Workers' Compensation (DWC Form-005)**, written notice to employees, and posted workplace notices. Ask us what's available on either road. Once you have staff, **employment practices liability (EPLI)** is worth a conversation too. On employment-law questions, talk to an employment attorney. We handle the insurance.

### Hail season is coming. Know your roof numbers now.

Wind/hail deductibles are often a percentage of the insured value, not a flat amount, and roof age can change how a claim is settled. Business income limits may not have kept up, either. Find out before the next North Texas storm. Free review.

## Whatever you built. Here's where the differences bite.

The right program depends on what you do, not how big you are. These are the situations that change the conversation for North Texas business owners.

[Home-based & solo operators

Your lease usually names the liability limits and the certificate wording. Your fixtures, inventory and the roof overhead all sit in hail country, so the property limits and the wind/hail deductible deserve a real look.](https://33north-ins.com/quote?type=business)

Your first hire brings the Texas workers' comp decision, and EPLI becomes worth a conversation. We'll walk through subscribing versus going nonsubscriber in plain English, and what each one means for you.](https://33north-ins.com/quote?type=business)

A rental house or a few doors across Collin and Denton Counties. One- to four-unit rentals are usually written on a landlord policy, often with an umbrella over the whole portfolio. See our landlord insurance page.](https://33north-ins.com/landlord-insurance)

General contractors and property managers set the requirements: limits, additional insured wording, and often proof of workers' comp before you start. We help you meet them and get certificates out quickly.](https://33north-ins.com/quote?type=business)

## Texas business insurance questions. Straight answers.

Do I need workers' compensation insurance in Texas?

Texas is the only state where workers' comp is optional for most private employers. Employers who go without it are called nonsubscribers.

Optional has limits. Contractors on government building and construction contracts must provide coverage (Texas Labor Code §406.096), and many general contractors and property managers require it by contract before you start a job. Going without is legal, but it gives up important legal protections if an employee is hurt. Ask us what's available for your business. This is general information, not legal advice.

What happens if I skip workers' comp and an employee gets hurt?

An injured employee can sue you directly in civil court, and Texas Labor Code §406.033 takes away three defenses an employer would normally raise: contributory negligence, assumption of risk, and fellow-employee negligence.

The employee generally needs to show your negligence contributed to the injury, and damages aren't capped the way comp benefits are. One serious injury can cost more than years of saved premiums, so make the decision deliberately.

What paperwork does a Texas nonsubscriber have to file?

Opting out is a formal status. Nonsubscribers file an annual notice with the Texas Department of Insurance, Division of Workers' Compensation (DWC Form-005), give written notice to employees, and post workplace notices stating they don't carry workers' comp.

Talk to an employment attorney about the legal side. We handle the insurance side, including options for either choice.

What is a BOP, and is it enough?

A Business Owners Policy bundles general liability, commercial property and business income into one package built for small businesses, often for less than buying the pieces separately.

For many Frisco offices and shops, a BOP is the core of the program. It isn't enough by itself if you give professional advice, hold customer data, have employees, drive for work, or need flood coverage. In North Texas, check the wind/hail deductible on every BOP you own.

Does my personal auto policy cover me driving for work?

Generally not. Personal auto policies typically exclude most business use, like deliveries, hauling tools between job sites or driving clients.

If the vehicle belongs to the business, it needs commercial auto. If employees drive their own cars on your errands, ask about hired and non-owned auto coverage, because their accident on your errand can become your claim.

I run my business from home. Doesn't my homeowners policy cover it?

Mostly no. Homeowners policies usually carry a small limit for business property and generally exclude business liability.

The fix is often simple: an endorsement or a small business policy. We'll tell you honestly which one fits.

What is professional liability, and do I need it?

General liability covers bodily injury and property damage. It doesn't cover a mistake in the professional services you provide.

If clients pay you for expertise or advice, like consulting, design, inspections or bookkeeping, and an error could cost them money, professional liability (errors and omissions) is the coverage that responds. Your contracts may require it. Ask us what's available for your field.

Do I need cyber insurance if I'm not a tech company?

If you hold customer records, take cards, or run your business through email and cloud software, you have cyber exposure.

Cyber liability can help pay for forensic work, customer notification, legal help and the income you lose while systems are down. What it covers varies by policy, so we'll go through it with you.

Do I need employment practices liability (EPLI)?

Once you have employees, it's worth a conversation. EPLI responds to claims like wrongful termination, discrimination and harassment, which can come up in any business with staff.

General liability policies generally don't cover these claims. On employment-law questions, talk to an employment attorney. We handle the insurance.

What does a commercial umbrella do?

A commercial umbrella sits on top of your general liability, commercial auto and employer's liability limits and adds another layer of protection when a serious claim runs past them.

It's common for businesses with vehicles on the road, heavy foot traffic, or contracts that call for higher limits than the underlying policies carry.

What does business income coverage actually pay?

Property coverage repairs the building. Business income helps pay your rent, payroll and lost profit while that happens, after a covered loss.

In North Texas, set the restoration period to a realistic timeline, because after a big hailstorm contractors are booked up across the region. Flood is excluded from most business property coverage, and flash flooding happens across North Texas, so ask us about flood coverage too.

Does my business policy cover hail damage to my roof?

Hail and wind are usually covered perils on business property coverage, but the details decide what you actually collect.

Wind/hail deductibles are often a percentage of the insured value rather than a flat amount, and an older roof may be settled at actual cash value instead of replacement cost. Check your deductible, your roof's age and your business income period before spring storm season, and call us after a storm so we can help you start the claim.

A client or landlord wants a certificate of insurance. What is that?

A certificate of insurance is proof of your coverage. Naming someone as an additional insured extends your liability policy to protect them for work you do for them.

Leases, general contractors, property managers and larger clients ask for them all the time. Send us the request and the contract language, and we'll work to turn it around quickly.

How much does business insurance cost?

It ranges too widely for one honest number. A home-based consultant and a business with a storefront, a crew and three work trucks are very different risks.

What you do, your payroll, your building and its roof, your vehicles and your claims history all move the price. Because we're an independent agency, we shop your coverage across several carriers and compare. Call us and we'll quote your actual operation.

Why use an independent agency for business insurance?

We represent multiple insurance companies, so we can compare options instead of offering one company's policy.

We work for you, not an insurance company. Robert Hutchings is a Texas-licensed agent based in Frisco, and we stay with you from the first quote through renewals as your business and the insurance market change.
